The impact of inserting competitive dialogue in public contracts

The New Public Tenders and Contracts, Law 14.33/21, brought important innovations in relation to its predecessor, Law 8.666/93, including the joining and regulation of all bidding modalities into a single normative instrument, such as the electronic auction. , as well as inaugurating the figure of “competitive dialogue”, used for contracting works, services and purchases. Through this new bidding modality, the Public Administration establishes a dialogue with previously selected participants, with the aim of developing alternatives capable of meeting their needs. This scientific article seeks to unravel this new type of bidding, its positive points, its innovations and how this can reverberate in public contracting.
