The present article begins with a brief discussion of the national doctrine's conception of what is understood by the right to happiness. These outlines are presented in order to better understand how the institution under study can contribute to the realization of the principle of human dignity. Following this topic, the characteristics of the former special concession for housing use are discussed, aiming to compare them with the institution of land regularization brought by Law nº. 13.465/2017. This comparison is made in light of the provisions of Article 72 of the municipal law of São Paulo nº. 17.734/2022, which allows the conversion of special concessions for housing use into instruments of land regularization by the Municipal Executive. Subsequently, the arguments put forth by different social actors supporting the unconstitutionality of these institutions are addressed due to their potential to allow private individuals to acquirepublic real estate. Finally, it is argued how the relaxation of the principle of the supremacy of public interest over private interest requires that public authorities also adhere to the principle of the social function of property.
